Identified officers of military court are posed with their right hands raised as they are sworn in around the makeshift field court bench while the prisoner waits seated on what appears to be a tree stump.

Miles, 14th Pennsylvania Cavalry, KIA at Millwood, VA; Lieutenant James Jackson, 14th Pennsylvania Cavalry, WIA at White Sulphur Springs, VA; and officers of the 2nd, 3rd & 8th Virginia (West Virginia) Infantry Regiments.
